Bangles and Spangles

William Overington

I have thought of how this song might be the first of a genre of spangleware (using a word I have coined for the purpose) where a work is copyright yet can be performed publicly free of royalty, yet a royalty is payable if the song is recorded. Maybe some performer starting out and looking for material might gather a repertoire of spangleware and sing at open mic' events and perform in restaurants and so on (maybe being paid or singing for supper) and if he or she gets a recording contract will perhaps record the spangleware songs and ensure that the songwriter receives a royalty. How about a CD entitled "Singing Spangleware" or perhaps a solo CD entitled "<name of performer> sings Spangleware". This song, Bangles and Spangles, actually discusses intellectual property rights in the words of the song - and why not?

Imagine a singer in a small venue somewhere where there is a dimly lit restaurant with lots of decorative copper and brass items on thick dark oak shelves and candlelight is dancing on the curves of the copper and brass and producing spangles of light which vary as we, as members of the audience, sit listening to the singer. She is sat on a chair in an open area. She is wearing a long dress, dark red with a small floral pattern in it. The word spangles bounces into creative nooks and she is wearing a copper bangle on her right wrist. It is wide and patterned with a scroll work design. Yet it cannot be seen from our viewpoint as we view her from her left and her right hand is hidden from our view by the guitar that she plays as she sings. She sings slowly and softly.

Bangles and spangles dance in the night
Candles light angles, as well they might
Bangles and spangles remind me of you
Bangles and spangles, sparkling and true
Bangles and spangles, spar....kling and true
This song that I sing
Is not written by me
By the terms of its license
I sing it for free
If I record it
There'll be royalty....
Bangles and spangles
I sing.... it for free
Bangles and spangles dance in the night
Candles light angles, as well they might
Bangles and spangles remind me of you
Bangles and spangles, sparkling and true
Bangles and spangles, spar....kling and true
On dark oaken shelves
Which blend into the night
From copper and brass
Gleam spangles of light
I move my head slightly
The spangles move too
Bangles and spangles
Remind me of you
Bangles and spangles dance in the night
Candles light angles, as well they might
Bangles and spangles remind me of you
Bangles and spangles, sparkling and true
Bangles and spangles, spar....kling and true
These lyrics I sing
First existed as text
Some fine notes of music
Were sparkled in next
On the island created
My voice now alights
Lyrics and music
And their copyrights
Bangles and spangles dance in the night
Candles light angles, as well they might
Bangles and spangles remind me of you
Bangles and spangles, sparkling and true
Bangles and spangles, spar....kling and true
In singing this song
I take every care
To aim at perfection
In gilding the air
For singing these lyrics
I need pay no fees
If I record them
There'll be royalties
Bangles and spangles dance in the night
Candles light angles, as well they might
Bangles and spangles remind me of you
Bangles and spangles, sparkling and true
Yes bangles and spangles, .... sparkling.... and true

As far as I’m aware, royalties on audio recordings are (like royalties on books) only payable when copies are sold, so the mere recording of a song performance wouldn’t trigger the payment of a royalty.

Re: Bangles and Spangles - now with Copilot art

I had not known that before.

So does that mean no royalty for the author of the copies of a book sent for Legal Deposit?

Re: Bangles and Spangles - now with Copilot art

Or for those copies of the book sent free to newspapers in the hope of a review being written and published?

Do you really want to dilute a discussion about spangleware by splitting it between two threads, William? Your earlier thread is here.

Re: Bangles and Spangles - now with Copilot art

Well, I had written three spangleware songs.

I added the second one to the same Copilot session and Copilot offered to write some more and I saw a line in one of them that produced an idea and, upon my requests, Copilot wrote a song for me and produced a picture as well.

Comets and Songs

A Spangleware Duet for Two Voices Style: Gentle country ballad with a touch of wonder and harmony

[Verse 1 – Singer A]
Some songs just wander in
Like strangers through the night
No name, no fame, no history
But suddenly feel right
I found these words online one day
They shimmered on the screen
And now they shine like stardust
In this old music scene

[Verse 2 – Singer B]
Some comets cross the sky
From places far and cold
They drift into our solar light
And blaze in arcs of gold
We never knew they’d come this way
But when they do, they gleam
Like songs that find a singer’s voice
And light a listener’s dream

[Chorus – Together]
Comets and songs, they wander in
           From places we can't see
They blaze a trail, they touch a heart
           Then fade so gracefully
But while they shine, they change the night
           And leave a trace behind
Comets and songs, they wander in
           And make the moment kind

[Verse 3 – Singer A]
I didn’t write this melody
But I gave it breath and tone
And now it feels like part of me
Though it was once unknown

[Verse 4 – Singer B]
I didn’t know your voice before
But now it blends with mine
Like two stars in a passing dance
That meet and realign

[Chorus – Together]
Comets and songs, they wander in
           From places we can't see
They blaze a trail, they touch a heart
           Then fade so gracefully
But while they shine, they change the night
           And leave a trace behind
Comets and songs, they wander in
           And make the moment kind

[Bridge – Together, softly]
So sing with me this borrowed tune
Let’s let it rise and fall
           For even fleeting beauty
Can leave the best of all

[Final Chorus – Together, with harmony]
Comets and songs, they wander in
           From silence into sound
They light the sky, they warm the soul
           And gently circle round
We may not hold them for too long
But still, they make us shine
Comets and songs, they wander in
And make your voice and mine... align

I presume that Copilot is currently only capable of writing lyrics, not music.

Well, at one stage Copilot output the following.

As it happened I requested a painting, so I don't know about the music these days at the moment.

I note that you have deftly sidestepped my question:

Royalties are not calculated according to the number of copies distributed, but rather as a percentage of sales receipts, so there are no royalties payable on free copies.

Well,,it did not start as a discussion about spangleware.

I have been entering the lyrics and, where one exists, of sxome of my songs into Copilot. Copilot responds, without being asked, with a review of the song, often very pleasing to me. I then ask for a painting.

So I had entered the Spangleware Blues as a song. Later, having entered Bangles and Spangles in another Copilot session after a New, I relearned that it was the first Spangleware song. I then added Spangleware for Nashville to the same seesion. So I suppose that I could now add The Spangleware Blues to this the Copilot session upon which this thread is based then they would all three be in the same session.

Here is a link to the index page for these songs and others,

I am amazed at the way that Copilot is incorporating the details.

The gong in Spangleware Blues, the dress colour with motifs in Bangles and Spangles.

And the Old Gold paper in the picture in the thread about The Clip Art Waltz.

Re: Bangles and Spangles - now with Copilot art

I added Spangleware Blues into the Copilot session.
